Digital Millennium Copyright Act (DMCA) Policy

1. Introduction

Playa Vista Living, Inc., a California corporation operating teamtami.com and playavistaliving.com (collectively, the "Site"), respects the intellectual property rights of others and expects users of the Site to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (17 U.S.C. § 512) ("DMCA"), we will respond promptly to notices of alleged copyright infringement that comply with the DMCA and other applicable law.

This policy describes how copyright owners can submit a takedown notice if they believe their work has been infringed on our Site, how affected users can submit a counter-notification, and how we handle repeat infringers.

3. How to Submit a Takedown Notice

If you believe that content on teamtami.com infringes your copyright, you may submit a written notification to our designated agent. Under 17 U.S.C. § 512(c)(3), your notice must include all of the following:

  1. A physical or electronic signature of the copyright owner or a person authorized to act on behalf of the copyright owner.

  2. Identification of the copyrighted work claimed to have been infringed. If multiple copyrighted works are covered by a single notification, provide a representative list.

  3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity, and that is to be removed or access to which is to be disabled, including the specific URL(s) on teamtami.com where the material is located. Provide enough information to allow us to locate the material.

  4. Your contact information, including your name, mailing address, telephone number, and email address.

  5. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.

  6. A statement, made under penalty of perjury, that the information in the notification is accurate, and that you are authorized to act on behalf of the owner of the copyright that is allegedly infringed.

4. Counter-Notification Process

If you believe that material you posted on the Site was removed or disabled as a result of a mistake or misidentification, you may submit a counter-notification to our designated agent. Under 17 U.S.C. § 512(g)(3), your counter-notification must include:

  1. Your physical or electronic signature.

  2. Identification of the material that has been removed or to which access has been disabled, and the location (URL) at which the material appeared before it was removed or disabled.

  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material.

  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if your address is outside of the United States, the Central District of California, where Team Tami is located), and that you will accept service of process from the person who provided the original takedown notification or an agent of such person.

Upon receiving a valid counter-notification, we will forward the counter-notification to the original complainant, inform the complainant that the removed material will be restored in 10–14 business days unless the complainant files a court action seeking a restraining order against the user, and restore the material within 10–14 business days after receiving the counter-notification, unless we receive notice that a court action has been filed.


5. Repeat Infringer Policy

In accordance with the DMCA, we will terminate, in appropriate circumstances, the accounts or access of users who are repeat infringers of copyright. We may also, at our sole discretion, limit access to the Site or terminate the access of any user who infringes the intellectual property rights of others, whether or not there is any repeat infringement.


6. Misrepresentation Warning

Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material or activity is infringing — or that material was removed or disabled by mistake or misidentification — may be subject to liability for damages, including costs and attorneys' fees.

Before submitting a takedown notice or counter-notification, consider whether the use of the copyrighted material constitutes fair use. If you are unsure whether the material infringes your copyright, we recommend consulting an attorney before submitting a notice.


7. How We Handle Notices

Upon receiving a valid DMCA takedown notice, we will promptly remove or disable access to the allegedly infringing material, notify the user who posted the material (if applicable) that it has been removed or disabled and provide a copy of the takedown notice, forward any counter-notification received from the user to the original complainant, and restore the material within 10–14 business days of receiving a valid counter-notification, unless the complainant notifies us that a court action has been filed.

We aim to process valid takedown notices within 3–5 business days of receipt.
